End User License Agreement

This EULA governs your use of the Death Dibs software (the "App"), separate from the Terms of Service, which cover the website and purchase process generally.
1. License grant
Subject to this Agreement, [LEGAL ENTITY NAME], LLC, d/b/a Death Dibs ("we," "us") grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for the purpose of maintaining one family archive (the data file the App reads and writes to your chosen storage folder).
2. Free trial vs. activated use
The App can be downloaded and used in a limited "trial" mode without payment. Purchasing an activation code and redeeming it in the App unlocks full functionality for one family archive. This is a one-time purchase, not a subscription — once activated, your license does not expire or require renewal.
3. What your activation code covers
- One activation code corresponds to one purchase and licenses one family archive (the license is not sold per-device — everyone in your family editing that same archive file is covered, with no additional per-person or per-device fee).
- Reactivating the same archive again — for example, after reinstalling the App, replacing a device, or recovering from data loss — is free and unlimited. Just enter the same code again.
- Redeeming your code against a brand-new, different family archive under the same purchase is limited to a small number of times over the life of your purchase. If you reach that limit and have a legitimate need for another (for example, starting over after a serious data-loss event), contact us — we handle these case-by-case.
4. How activation works (and its limits)
When you activate, our server issues a cryptographically signed license that gets embedded in your family archive file. After that, the App verifies the license entirely offline — it does not need to contact our servers again to keep working. This means: (a) the App keeps working even if our servers are ever unavailable long-term, but also (b) we have no remote "kill switch" to disable an activated license — see our Refund Policy for what this means for refunds after activation.
5. Restrictions
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the App, except where applicable law expressly permits it;
- Circumvent, disable, or attempt to defeat the activation or licensing system;
- Sell, rent, lease, sublicense, or otherwise transfer your activation code or license to anyone outside your own family/household use of a single archive;
- Use the App to build a competing product or service.
6. Ownership
The App itself — its code, design, and branding — is owned by us and protected by copyright and other intellectual property laws. This Agreement gives you a license to use it; it does not sell you any ownership interest in the software. You retain all rights to the content you enter into your family archive (item descriptions, photos, funeral plans, etc.) — that's your data, stored in your own cloud storage.
7. Not legal or estate-planning advice
The App is an organizational and communication tool. Claims ("dibs"), item notes, and funeral/end-of-life wishes recorded in the App are not legally binding and do not constitute a will, trust, or other estate planning instrument. Use a licensed attorney to prepare any document you want to have legal effect.
8. Termination
This license terminates automatically if you violate this Agreement. Because activation is verified offline (see Section 4), termination may not immediately disable an already-activated copy of the App; we reserve the right to refuse future support, updates, or reactivation for accounts found in violation.
9. Disclaimer & limitation of liability
The App is provided "as is," without warranty of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including data loss. Our total liability under this Agreement will not exceed the amount you paid for your activation code. See also our Terms of Service for additional disclaimers.
10. Governing law
This Agreement is governed by the laws of the State of Texas, without regard to conflict-of-laws principles.
