Plain-English summary: Death Dibs is a one-time purchase. There's no subscription and no company server holding your family's data — everything you enter is saved to a folder on your own Google Drive or iCloud. Nothing you or your family enters in the app (claims, wishes, item notes) is a legally binding will or estate document — see "Not Legal or Estate-Planning Advice" below. These Terms are a working draft and have not yet been reviewed by an attorney.

1. Who we are

2. What Death Dibs is

Death Dibs is a downloadable app (mobile and desktop) for cataloging physical belongings, letting family members indicate which items they're interested in inheriting, and recording funeral and end-of-life wishes. The app is free to download with limited functionality; a one-time purchase unlocks the full app via an activation code, as described in our End User License Agreement.

3. Your data stays with you

Death Dibs does not operate a database of your family's inventory, claims, or funeral plans. The app reads and writes a data file directly to a folder you choose — typically one already synced by Google Drive, iCloud, or a similar service you control. We never see, store, or have access to that file's contents. You are solely responsible for keeping that folder backed up and for controlling who has access to it (for example, by managing sharing permissions on your Drive or iCloud account).

4. Purchases

Death Dibs is sold as a one-time purchase, not a subscription, processed through Stripe. Purchasing gives you an activation code tied to one family archive, as described in the EULA. See our Refund Policy for what happens if you're not satisfied.

5. Not legal or estate-planning advice

Death Dibs is an organizational and communication tool only. Marking an item as "claimed" or "dibs'd" in the app, or writing down funeral wishes, does not create a legally binding will, trust, beneficiary designation, or other estate planning document, and has no legal force in probate or any other proceeding. It exists to help your family talk about these things ahead of time — it is not a substitute for a will, trust, or other estate plan prepared with a licensed attorney in your state. If you want any of these arrangements to be legally enforceable, you must put them in a proper legal document.

6. Acceptable use

You agree not to:

  • Use the app for any unlawful purpose, or to enter content you don't have the right to enter (for example, photos or documents you don't own or have permission to use);
  • Attempt to circumvent, reverse-engineer, or defeat the activation/licensing system;
  • Resell, sublicense, or redistribute activation codes or the app outside the terms of the EULA;
  • Interfere with or attempt to gain unauthorized access to our licensing service or related infrastructure.

7. Disclaimer of warranties

The app and website are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free, that data loss will never occur, or that it will be compatible with every cloud storage provider or device configuration.

8. Limitation of liability

To the maximum extent permitted by law, Death Dibs and its owner(s) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of (or inability to use) the app or website. Our total liability for any claim relating to Death Dibs will not exceed the amount you paid for your activation code.

9. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use the app or website after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, regardless of where you access Death Dibs from. Any dispute will be brought in the state or federal courts located in Texas, and you consent to jurisdiction there.
